I'm the assistant director for the arts in the Department of Economic and Sustainable Development I can hear tonight to talk about wrapped in love So we recommend the approval of Middle Way houses annual wrapped in love program So this is a program in which Middle Way house Wraps trees that are in the public right-of-way with sweaters that have art designs on them And they also advertise their crisis hotline on a placard on each of the trees with a sweater so starting in 2023 the city began a partnership with wrapped in love because the city's policies aligned with the perspective of Middle Way House that folks deserve resources when they're in a crisis. And when that took effect, basically what that means is that all of the art and the globally recognized symbols on those sweaters, as well as any language either on the sweaters or on the placards, become government speech. And when that happens, that means that that speech is actually exempt from our art and the right-of-way So that means that any globally recognized symbols or language that are represented as part of this installation are Okay, so for all of the designs so many most of the designs that are coming back this year are designs from previous years There are four new designs this year that should be in your plaque in your packet Legal has reviewed all of those designs and said that they are they are permissible Aligning with city policy to be able to display them. So these sweaters will be Reinstalled beginning on September 15th through October 7th There will be a ribbon cutting ceremony for this year's sweaters at courtyard square on October 3rd And then the sweaters will be up on the trees through January 15th 2026 and that's when they'll all be de-installed And that's what I've got. Thanks Next we have change order six for Winslow Rogers resurfacing project with milestone contractors LP Jason Kerr with engineering Excuse me change order six for Winslow Rogers resurfacing project is a quality adjustment and Back in mid-july, there was a rain event which caused some erosion issues within the corridor down at the roundabout high Winslow and Rogers They were instructed by a certain date to put erosion control and matting Around the roundabout on the inside area. They are delayed today This is coming for for the quality adjustment, which is the deduction of the contract price of $200 that we charge for that one day of Missing erosion control with the deduction of the $200. It brings it to 1 million four oh five eight sixty seven dollars and ninety four cents Any questions on change order number six? Thank you questions from the board and Jason not necessarily a question about the change order But I believe I did drive through that intersection the day of the the rain incident Are there any? Long-term changes needed to get the roundabout to drain differently or drain better. I roach I Cox Deckard I motion passes Next we have change order number seven for Winslow Rogers resurfacing project with milestone contractors LP and Again from engineering change order seven takes place at Somerset place and winter on Rogers Road at that point at the northwest corner there was a new curb ramp put in but the one was say the Graze behind that were relatively steep. So we're adding a Retaining curb to help hold that bank back and to keep any sediment from coming on to the new curb ramp This is approximately 28 linear foot of curb going in change order also adding three days to the overall contract duration with this change order number seven in addition of 35 31 dollars and 33 cents brings the grand total to 1 million 409 399 and 27 cents and It's just the addition of that curb retaining curb any questions. I'm Jeff Jackson with ESD staff recommends you approve the Application to award a bird another annual licensed operate in city of Bloomington Yesterday I had one question about the ratio of e scooters to e bikes, there's Just a little over 58,000 trips on e scooters During in over the last year and just over 5,000 e bike trips. So about 9% are you bike trips? That's information provided by bird Thanks for that information are there questions from the board on this item I Apologize if this was discussed yesterday, I wasn't here for the work session But is there a reason that this is titled with bird for scooters and not scooters and ebikes? Are you talking about on the agenda in the actual resolution? Yeah, it's the item on the agenda. Let me look at the Resolution here Good question. Yeah, they're have a license for an e scooters and ebikes Are we approving the contract or the resolution? The application they submit has a signature page that bird signs and the resolution that you approve has a signature page for the Board of Public Works to sign Okay, and it's not on the agenda for the resolution but we can assume that that's part of the yeah, I think it's more of just the The wording that's always been used in the past. It was primarily a scooter based on Resolution but it does include the language in the resolutions and such as necessary to okay have the contract executed is the way I would Yep. Yeah the resolutions in the packet as well. Yeah, I see Okay, thank you One question that I had asked During the work session and just wanted a little bit more clarity. We had talked a bit about the discretion of the city specifically the Department of Economic and Sustainable Development to work with the Provider to adjust the number of deployed scooters And presumably e-bikes as well if that were an issue based on their ridership is there any or concerns about the ridership versus the number of vehicles like in the in the contract language it says That the operator shall deploy 700 vehicles and that ratio is 455 e scooters and 245 e bikes. So I'm just wondering are they Is the usage coming in at what the city? expects for that number on the fleet or is there any plan to adjust that the bird currently has 500 units deployed They're going to add another 200 by October 1st to get up to the required levels If any of the usage falls below a certain threshold we could ask them to reduce those levels given the fact that Less than two years ago. We had over 1200 units out there with three providers It doesn't seem likely that would occur, but we'll certainly stay on top of that First to that point we get Correct me if I'm wrong here Jeff. We get monthly reports on that usage and such we you know, there is that information exchange So if if by chance, you know, they have say the 700 full units here It's apparent that they're only being used 300, you know, we can see that information and make those requests I think to date we've just never had the need to actually make a request for reduction. Is that a fair way to say it? That's correct. Yeah, awesome the other point in the actual documentation for the resolution The resolution is title a share micro mobility devices So it's I think it's just more of the wording on the agenda that we'll make sure to use micro mobility instead of just scooters in the future Has there been any either increase or decrease in the number of You reports or other complaints about accessibility with scooters being left on the sidewalks. I couldn't tell you just Like absolutely if there's been an increase or a decrease I think My Use of the report system on a regular basis sees I would say I think I see less of them overall. Yes We also reviewed some of the fine data that we've got through throughout this year. We're still enforcing with parking enforcement something I had it pulled up a minute ago and I this quote But over 350 fines were issued since the beginning of the year this year. When staff sees improperly parked scooters, they issue the fines, the fines have been collected. They're tending to happen outside of the core of the downtown because of the corrals being successful. So my hope always was as we got the corrals built, we could focus more on the neighborhoods where we hear from the residents that are trying to walk on the sidewalks that we're encountering the things. I know there are still There are still violations occurring when we get to when we get word of them. We go and respond so but I couldn't tell you Exactly if the number of complaints that's gone up or down, but we could pull a report on that for sure To be making different downtown. Oh, absolutely. Yeah I mean you still see the random ones that are outside of a corral here or there but for the vast majority of the way that geofencing is working a lot less issue downtown and I would also say that I think a lot of the, well, I would, I think some of the instances of the cart, of the scooters not being in the corrals is not necessarily the end user that might have left it in the corral. It's once it's happened, once it's in the corral, it gets moved without being rented. Is the way I'd say that. Disrupted in some way. Yeah, whether it's, you know, late night tomfoolery or anything like that. Which never downtown never All right and other questions from the board on this item If the board doesn't have any other questions, I'll just make a general comment. I think I'm kind of excited I'm excited now that we have one vendor. We have one point of contact. We have you know You know when we had the three and the four vendors when we were first responding to this it was Very much that disruptive technology approach to everything. I think we've got a better handle on it. It's not perfect They still are out in public in traffic all the things but I think it's gotten better overall and I think with having the one vendor will still be able to even Fine-tune it make it better. They're talking about putting in new corrals that they're gonna be required to put in and thinking about location. So Hopefully, you know, we we continue to lessen those number of instances where they're causing an issue whether accessibility or otherwise One question I do typically ask is does the city feel satisfied with the level of safety information and safety events the bird is hosting or Disseminating among especially new riders. It's that time of year where we have a lot of new Residents, you know figuring out the scooters birds been very responsive the Safety requirements outlined in the package They show up to events when when requested and other times that they schedule themselves they give away free helmets and do demo rides or do training for the for the e-bikes knee scooters, so the other part of having one vendor is that they've been very responsive and both with responding the new reports and meeting their safety requirements and obligations and Good time of year to probably we'll make a request that they come in town here soon. Yeah Yeah, it's a good good time to and the weather has been so good.
