Are there any messages from the board tonight? Seeing none. Next on the agenda are appeals. We have two appeals tonight. We will start with the noise appeal at 613 East Brenda Lane. Again, Adam Weissen, Public Works Director. This is on behalf of city legal and Bloomington police but on March 13th 2026 around 10 30 p.m. noise citation 4 0 7 8 4 was issued by to Vincent LaBella at 6 13 East Brenda Lane by officer shields. They received a call from dispatch regarding loud music coming from the garage area of the home. The officer parked at the school. nearby and could hear the music from the road and the music was pending for more than 15 minutes prior to the issue and so the citation and I do believe we've got the appellant here in the room but it was decided that the There was a violation of Bloomington Municipal Code fourteen point oh nine dash oh one oh and BPD recommends that the citation be upheld based on that information. And if Mr. LaBella would like to offer anything to the board he is welcome to you. If you if you would please state your name at the podium and then we'd be happy to hear what you have to say. Thanks. So my name is Vincent LaBella on March 13th of last month. Received the noise citation at my my own home I'm appealing the citation as it was issued without a prior warning and contains minimal detail regarding how the noise violation was determined The incident occurred around 1030, which is near the beginning of typical quiet hours I was not made aware that the noise had reached a level that would result in a citation and I would have immediately complied if asked Additionally, the citation does not specify any measurable standards such as distance or decibel level used to determine that the noise was excessive and This is my first offense and I take responsibility for being more mindful moving forward I respect the purpose of the ordinance and maintaining peaceful environment for my neighbors as a first-time homeowner and a lifelong member of the Bloomington community I'm committed to being respectful and compliant with the city standards. This is my first offense and I will ensure it does not happen again I respectfully am asking for a dismissal or reduction. I Appreciate the time and consideration regarding this matter and request a favor of resolution Thank you very much New questions from the board is the officer present with us on zoom. Yes. And the first fine is fifty dollars. So the first offense is fifty dollars and their warnings are not part of not part of the citation process for noise violations. So any other questions or other questions from the board. No I don't have any other questions. I just was going to restate from the the staff report because it was mentioned in the appeal document that there wasn't a specific measure that it was Found against and that is in part because of the way that ordinance is written that it's not based on a certain decibel level or a measurement but rather If there is noise that can be heard from outside of the Under the Bloomington Code chapter 14 additionally, there is a pending time limit. So it's 15 minutes once it's called from dispatch. So the officers do make sure that that time frame is met before they go in to check and so the it's the reasonable person measure under Chapter fourteen point oh nine zero one. Oh as as written in the staff report Unreasonable unnecessary excessive and offensive noise from all sources subjects subjects to its police power It's unlawful for any person to cause or make unreasonable noise or to allow any unreasonable noise to be caused or made on any real or personal property. So we would argue that there was noise. That is a fact. And the citation was issued. And the noise had been pending for 15 minutes once the call came in from dispatch. And also that warnings are not part of, it's not under our code to issue warnings for noise appeal, noise citations. Just confirm that the call log we have in our packet Does mean that a complaint call was called into dispatch, which is correct. Okay. Thank you I do want to make one correction that I noticed in the staff report There was some language from one of the previous carryover cases on both of the staff reports for the noise or noise appeals and section under our facts there's language included in here about the apartment when teaching his roommate how to DJ that's from a previous one that was not edited out of this document and that's in both of these staff reports for tonight that will be struck from the record that's not for that was an error to be included so thank you I did see that when I was reading over the weekend and neglected to bring that up at the work session so thank you for saying that last appeals okay sorry Is there any public comment on this item? Thank you for the assist there Emanuel And this was issued by officer Chad Dorman. It does not appear that officer Dorman is here this evening Do we have him online by chance? Okay, and so The officer became alerted to the noise when they received a call from dispatch regarding loud music coming from the home Reported by the roommate the roommate left left Officer Dorman into the building where the officer could clearly hear music and visually saw about 10 to 10 to 15 people partying And the appellant is here. This is another case where it was declared that the policy of the city was violated and prohibiting unreasonable unnecessary excessive and offensive noise from the sources above certain levels and is detrimental to to the well-being of the public nearby. Also just stating that that it was a standard of unreasonable noise and that a complaint was received on this one as well. If the appellant would like to offer anything to the board now would be your chance. If you could state your name please at the podium. My name is Emanuel McKenzie and on the 18th of March there was a noise complaint. For my understanding, on that particular day, it was an apartment to be precise. I had a few friends over. It was during the spring break. And I don't want to cause a disturbance or anything. Before I had this gathering, I spoke with my neighbors that I live with and I asked if I'm going to be having people over. So they said, oh, you can do that, kids. We're not going to be here during the spring break. On that particular day, I spoke with my roommate. I lived with three other people. One of my roommate was not here. He went home for spring break. The other two people, I had a conversation with the other person. And the last person that reported this, that was my, I made a mistake and I forgot to inform him because I had some other things. I was supposed to tell him the old thing that, oh yes, I was having people over, but I made a mistake and I forgot to inform him that But on that particular day, I was playing music, but not so loud to the point where it was causing too much disturbance to the other people in the building. But I feel like that noise is just too much for my neighbor, World's Liveaway, and I take responsibility for that. It wasn't my intention to make them uncomfortable because I was supposed to communicate with them, but I made a mistake not telling them sooner than before having the party over. And I apologize for wasn't making noise, causing a disturbance to my Roommate and I just hope I could get a second chance. Um So because this is my first offense and I've made um Steps not to make this kind of mistake again not to cause disturbance saying I've better communication with my tape with my roommate Questions from the board Just Question from city legal we were talking about the 15-minute time period in the prior noise appeal I just want to confirm that that was also upheld and the 15-minute time period was upheld in this one as well They wait 15 minutes from the time that they get the call of dispatch to see if the noise becomes unreasonable if it continues so In this particular case, um, when the officer arrived, uh, the call was actually, actually came from the roommate, um, from Mr. Kenzie's roommate. Um, and the roommate did lead the officer to where the noise was coming from, but, um, well before the officer, um, got to the actual apartment, he could, um, hear the music and he visually saw about 10 to 15 people, um, in the home. Um, again, I stated in the previous citation BPD does not issue warnings for the citations. So we initially entered into a contract with Crossroad engineers PC to do the subdivision and the design of the Hopewell South Neighborhood that the RDC is moving forward. There's a PUD being considered by City Council actually tomorrow and then a lot of work to follow whatever comes out of that but these specific items were not identified in the initial contract this is a new water main in Wiley and stormwater detention along Wiley. This is something that came about after further evaluation of the site. This is something that would be required no matter what kind of development is going into Hopewell South, so it's not dependent on the PUD. So we're moving forward with the contract amendment to add that survey work. This also includes additional geotechnical exploration on the 714 South Rogers building site, which is kind of being Pursued for some kind of reuse. There's some testing going on with the geotechnical Consultant that will help inform what that site can be used for so those are the two items in this contract amendment tonight Just for your knowledge. Good evening Sarah Gomez with engineering department requesting approval for the award of contract to be paving for the Grimes Lane Kirkwood Avenue Patterson Rogers maintenance project. The project includes resurfacing restriping and other work, including replacing a traffic signal at the intersection of West Kirkwood and Rogers Street, reconstruction of pedestrian curb ramps and crosswalks and other related maintenance work and the project limits. The maintenance of traffic for the project will include a full road closure on West Kirkwood, which will be a maximum of 10 days, not necessarily consecutive. For West Grimes Lane, Patterson Drive and South Rogers, One lane road closures will be in place throughout the project. The bids for Grimes Lane Kirkwood were opened publicly and read aloud at noon on April 10th twenty twenty six at City Hall atrium EMB paving was the lowest responsible and responsive bidder with a bid of four million six hundred seventy nine thousand nine hundred fifty fifteen dollars and ninety nine cents. milestone contractors at four million six hundred eighty five thousand six hundred ninety six dollars and fifty nine cents and Criter and Criter with five point sorry five million four hundred seventy four thousand thirty two dollars and thirty five cents engineering recommends awarding the contract to EU and be paving as They were the lowest responsible and responsive better Happy to answer questions Thank you questions from the board Do we know roughly the timeline for the project? It's 180 days, so it's a very tight timeline. And after award tonight, we will figure out when that start date is. I imagine they'll want to start as soon as possible, maybe May 1st. And then there are restrictions on the closure on Kirkwood as well as the other part of the project. Believe the dates are May 22nd through June, August. I can't remember the exact date, but yeah, before students return. Avoiding the problematic traffic time, which is, of course, what I'm asking. Of course. So I'm actually currently also looking at a document that talks about all of our projects that we have going on throughout the whole community this summer. And so we're balancing a lot right now. Pavement maintenance projects that are outside of this contract that are also adjacent To the area where we're gonna have paving here You know, this is these are all of the main thoroughfares in that kind of quadrant of the city from the Norbert Nordic site north on Patterson up to third and fifth Kirkwood because it wouldn't be a road in Bloomington without three names. And then over to the portion of Kirkwood we're actually going to do from like Adams to... We're going Pine to Rogers. Pine to Rogers. You know, so we're Coordinating all of these with other projects in mind as well We also still have the continued work on 2nd Street throughout the summer with utility relocation. So the folks like Sarah and You know the the street staff and everybody that are doing the like fine fine tuning coordination of balancing all this Really appreciate those efforts because there is a lot of balancing that we're trying to do with all these various projects It wouldn't be a summer in Bloomington if we weren't closing some streets. Yes All in the name of good investments into our infrastructure for long term maintenance and minimum impact trying to get them all in during the same time period. So appreciate that coordination. I just want to confirm you said that the full closure at West Kirkwood and Rogers would be 10 days not necessarily consecutive days. And it won't it won't just be at Rogers intersection. It would be along that corridor from pine to Rogers because we are putting in some raised crosswalks for safety purposes. So those will be needing maybe a few days closure each. And so those will be spaced out over time depending on how the contractor wants to get it done. So it'll be up to them if they want to make it consecutive or not consecutive. OK. That's helpful. These poles will be connected via underground wiring to an existing power source located at an intersecting hand hole. Construction is anticipated to take approximately three weeks and is expected to occur between April 22nd, 2026 and May 31st, 2026. Sidewalk closures will be required during construction activities. This is something we've been working on for last several months with staff from several city departments including parks and recreation engineering department and others and So this is a program that will seek out sponsorship monies for the support and maintenance of four of our roundabouts and this kind of this came to us after some interested parties and asked about any programs that we had in place for such work and Realized we didn't have anything formal in place that really could Help us to meet some of our goals to not only beautify but maintain several of our roundabouts There is a sponsorship agreement that's been included in your packet And this will also go to the Board of Parks commissioners for their approval some things to note that there are You know several of goals or intentions listed here in terms of the beautification and such, but also that there are terms in which the sponsor provides the financial support and what type of recognition they get in the roundabout with signage and such. It also lists out that there are Industries and products that may not participate in the adopter on about program including religious religious organizations party based or issue based political organizations or campaigns Businesses regarded as adult businesses as defined by Indiana code and companies that derive 50% or more of their business from the sale of any of the following alcohol tobacco or vape alcohol tobacco or vape products firearms or ammunition pornography or gambling so there are some restrictions and some language in there to that Outline who may not participate in this type of program and then just also list that the program is a 12-month sponsorship and that the Board of Parks both the Parks director and Parks Department and the Public Works Department will work on these sponsorship and agreements in partnership Any questions from the board Regarding the Sponsorship levels, is there like a maximum number of sponsors per roundabout? Okay, so as many as we can fit the signs in we could have like multiple you could have a landmark or but also a welcome maybe in the same roundabout potentially. I don't know that we'll have overwhelming number of individuals or businesses knocking on the door but we have a few that are interested and you know Ideally, we would seek sponsors of all of the different roundabouts instead of multiple ones at a single one But we also understand some of them probably have higher traffic counts than others, etc. So Imagine a situation where they'd prefer a certain roundabout exactly. Yeah Does this language match other city sponsorship Activity like what is it? Is it crafted from something that has parks parks has had sponsorship for trees Beeline backers program, so We pretty much pulled from previous examples work for city legal I believe some of the language may even come from the adopt a road sponsorship program that we've had partnership with the solid waste management district on so We did not try to reinvent the wheel One is about the recognition signage says it shall not exceed 16 square feet in total area per sign that 16 square feet is that four by four feet? Yes, just like is That's a very very large sign with that not impede No, so when you really think about it in traffic You'd be surprised at how small 4x4 sign would actually look as you're in a vehicle or something like that. It would not. So all of these standards are based on the UDO and the manual on uniform traffic control devices, otherwise known as the MUTCD, and their signage standards for roadway signage and such. Okay. Thank you. I'm not an engineer. It just sounds large to me. Yes. Overall not as big as you would think. Okay And I just have a question for city legal This came up yesterday during our work session and I would just like to make sure our colleague who is not here Has his voice heard could you explain the list of industries and products that may not participate in the program how that was defined and I can tell you that I was part of this conversation largely with parks and they have the same list when it comes to park sponsorship So who can put up banners and who can sponsor things? through their programs Frankly, I would have to look back at At the statute, but I believe that there's a lot of those things are taken from statute, especially the definitions of things Some of those things are just are some of the items on the those lists are pretty standard for municipalities or other governmental entities there are already pretty strict guidelines we have to follow when you talk about political signs in on government property Potentially religious signs on government property. So there those are already things that we have to be very conscious and careful of And to avoid bringing everything back to this board every single sign back to this board It can be easier for us to make a rule with these items on the list I cannot remember the basis for decisions regarding adult products, smoking, vaping, alcohol, those kinds of things. But I can tell you those are also pretty standard in governmental prohibitions regarding signs and advertisements on government property across governmental entities. Thank you. Yes. Other questions from the board? We did at one point in the distant past have some sort of sponsored like roundabout sponsor situation. This is a long time ago. I'm just curious. I don't remember all the details of it. This seems like a more formalized process, though, than what we had before. So I'm just asking, like, is this essentially an improved process compared to what may have been in place in the past if any organizations had participated in the plan? Yes. One of the things I didn't quite have time on my plate, this was on a to-do list for quite some time to get it updated. And we brought on some new staff that was able to devote the time. Shout out to Cassie Warnie for her work on this. It was just one of those where it finally had somebody that was able to put the time and effort to work with parks, get it formalized, get it updated, and make it something that would work better. It still has terms and language on if the sponsor is not meeting their obligations, things like that. But one of the issues in the past was that the sponsorship often included the maintenance side of it from the sponsor. Pulling weeds from around about in the middle of Sarah and Rogers probably not your favorite day of activities for most people So we did have some issue in the past with that. This is more of a financial contribution So then we can then contract for the maintenance. Yeah, I noticed that which I thought was an improvement an improvement, especially for the sponsors Great. I think we've got a much more clear and concise reason for how we've ended up where we're at here. But this is amendment number two not amendment number one and it is in the amount of two thousand four hundred and eighty dollars. This is just an amendment to add 12 months of additional of an additional time period. for the photo images from the data collection project that we're doing that we would have it for an extended period of time being 12 months. I think he forgot he had a follow-up on the IU circuit relocation notification I did meet with him today and We discussed the Duke energy's process for notification, um, with Corey, um, Hamlin from Duke energy and he did send an email out to them, um, to get a little more clarification on it. However, they do have a text messaging and a, um, email notification process for 72 hours before the outage is, um, going to occur. And, They also have to this was the other thing that I think we missed yesterday in the work session is clarification that they have to meet the iurc standard of Notification process for an a scheduled outage. So all we are doing is approving the noise during that time period the iurc really navigates the notification for those longer period of time outages which when Zach and Kyle followed up. It is a 72 hour notification that they will be Aware of but we did try to get more information on exactly which businesses in advance of this so that we can get That that figured out and this is Something that was requested by the KCA. It is an update to this circuit relocation. That is their dedicated circuit for These power outages to not happen and that at those download Downtown locations. So Kyle is pretty sure that all of the businesses down there are aware because they're in favor of having this upgrade done to this circuit Thank you, all right That report for me now just really quickly Lots going on we're starting construction season as we talked about with the contract for the paving with West Kirkwood Patterson and Rogers We have major projects going on throughout the entire summer as you know as is kind of typical around here for summer construction season, but We will have several projects kicking off right after graduation that Monday May 11th including our Kirkwood sidewalk project with brick rehabilitation. We are repaving our downtown parking lots. So the surface lots that are under city control downtown are all getting a refresh and with pavement. We've got several other contracted pavement projects on 6th Street. on 5th Street between College and Walnut Kirkwood between College and Walnut. We've got alley projects that will take place between 8th and 11th College and Walnut. So busy busy active summer. But these are the investments that we need to be continuing to make will be issuing a news release. We've got some different On the data portal. We've got some different maps that outline all these projects and where we're going to be working on things So just want to make the public aware.
