Good evening. Let me call to order this meeting of the city of Bloomington planning commission for June 9th 2025 Start with just a quick overview of the agenda this evening we will do a couple of internal housekeeping items and Then we'll get on to our agenda. We've got four petitions that remain tabled That will not get a hearing tonight. That's SP 24 - 22 cutters Kirkwood 1 2 3 LLC Zio 34 - 23 City of Bloomington planning and transportation those are the text amendment related to sign standards Zio 1 - 25 which is some text amendments to the UDO and then Zio 3 - 25 additional text amendments related to single-room occupancy All four of those remain tabled. We have two petitions that we will hear tonight Those are Zio 0 7 - 25 and Zio 0 8 - 25. Both of these are amendments to the UDO that Have been returned from Common Council. Thank you because we have an online Commissioner we will have to do a roll call vote on on everything here tonight just to Make sure we're keeping the record straight And just as a reminder We need a majority of the entire Commission not just a majority of those present So we will need five five out of seven to take formal action on anything here tonight The first thing will be Minutes, so I do think we have some minutes to be approved the packet shows that we have many minutes from the May 12th meeting But there was I think a question about March have we taken action on the March minutes No, do we have those? tonight We have already Did you send them? Yeah, we can you can vote on those we sent them. You got them with the May minute. Okay, so we'll do We'll do a separate vote one for March one for May. So I would like to ask that it be corrected on The last motion it indicates the phasing Plane for the construction was approved and I know we didn't approve any planes. Mr. Stossberg, I'm not sure if it's a report so much as a question But I think this is about the only place to put it I would be interested in a public update regarding Zio 1 to 5 the text amendments regarding affordable housing incentives Because that has been on there for far too long and last time we talked about it. There was Some potential thought to separate two of those things. One of them needed more thought there is maybe going to be some small group work done and as the author of the resolution that Prompted this petition. I would really like an update for council All right, Jackie Scanlon assistant director So as you saw last week director Hiddle presented to the Common Council That we will be working on a robust public outreach process to address some of the issues that were present in councilperson Rosenberger's Resolution that was not That did not start at council. It was not voted to be heard and so this is kind of in tandem with that but to Commissioner Stossberg's point. Yes. I do think that there is one piece that can come out So when I'll be talking about this briefly in a moment, but when we bring you do amendments next month We if it's determined that it is okay to take that to bring that forward by staff Then you will see that portion next month Yeah Okay, because I mean I would at least like the one part that deals with the affordability percentages Which we had a whole presentation from hand about and I really would like to get that Moving through the process Okay. We need to take care of here with regard to an appointment if you all recall we when we made a Appointments at the start of the year one of the things that we did not do at that meeting is point someone to the Traffic Commission Transportation Commission. Thank you. We have There's a seat on that Transportation Commission reserved for an appointee from the plane Commission No, no, no one on the Commission volunteered for that. So we do have now I think a candidate that staff feels would be a good appointment for us and I'd like to take action on that Tonight Jackie anything you want to add on that Okay, so we are recommending the appointment of Mark Stossburg he is a community member He applied online to be a member of the Commission. He used to be the president of the bicycle and pedestrian safety Commission I think which is great, but I think more notably he has done a number of reports and analysis on Some of our transportation issues in the city on his own And I think think that could be helpful. So we're recommending that you appoint him He does only want to serve for a year currently so you would be appointing him I think you could probably make the motion to have it be a year or we'll just you know, he can resign at the end of this year and we could Hopefully appoint someone else next year Because sorry because the positions that are filled by members that are not playing commissioners are two years If one of you chose to do it, it would be it would run concurrently with your plan Commission appointment So the recommendation is that we point Mark Stossberg is there any Are there any questions from commissioners? None Commissioner Stossberg, do you wanna I was waiting for a motion not a motion on the table yet This would someone like to move for the appointment of Mark Stossberg to the Transportation Commission to approve Mark Stossberg as our appointment to the Transportation Commission second second All right, Commissioner Stossberg and now I'll go ahead and recuse myself from this vote If you don't know I am married to Mark Stossberg. Yeah, we just wanted to briefly go over Again Jackie Scanlon assistant director Some mailers went out last week. You may or may not have received one if you're a property owner, you should have received one here in the city and they are related to our Udo update that we are undertaking That will come here to Plan Commission next month. It's a handful of Use updates so you may recall that when we do our annual update, we don't update uses anything related Anything in table 0 3 - 1 because that requires notice to all property owners affected And so we have kind of been like gathering those over the last four years so that they could all be done at once because we have to the noticing is expensive and so We have had a couple kind of instigating things to have us do this this year One is the resolution 2024 - 25 that we received from the Common Council related to updating One of our uses to a single-room occupancy and some changes to how that use works Additionally, we have been in discussion with through an enforcement case with a local property owner who was doing urban agriculture on their property and working Through with them and their representatives About that use so both of those things need to be addressed this year So the other items are items that we've kind of been keeping on the list since that time so they will be first discussed at the July 14th Plain Commission hearing and if you all choose and There are a number of ordinances like we normally do where we split them by type So some you may choose to send on and waive the second hearing others You may not or you may choose to you know, hear them all twice or longer But so they are in an ordinance related to single-room occupancy again in response to that resolution from Common Council And Actually, that's probably too busy and then one related to urban agriculture commercial one related to Requiring self-store self-service storage areas to be on our larger Arterials as opposed to some of the districts that are in smaller areas The same for vehicle fuel station and vehicle wash limiting those to our busiest districts district mixed-use Corridor and then the ones under the that we're calling general use table changes. They're They're smaller. So the fraternity and sorority correction is That you may review you've been on the Commission for a while You may remember we had some litigation with a fraternity and sorority and we had a number of use specific Standards in the code and then we took those out. So there are no use specific standards for that use but removing the asterisk Asterisk in the table would have required notice to everyone to all the districts. So we are just removing that asterisk to nowhere Allowing for artists studio and workshop to be Artist to your workshop in office to be potential uses in the MS in the mixed-use student housing district So what we've seen and some of our mixed-use buildings built in student housing is vacant ground floor what we would typically be commercial and office and Artist studio or not uses that are allowed there now. So allowing those to be an option We have been getting calls from realtors for some time about making that change So it's been on the list the two changes to vehicle fleet operations. You already Approved and council approved as well the use specific standards related to autonomous vehicles and and this use This is just adding the asterisk and reference into the table so that it'll be clear That those are connected and then the tattoo or piercing parlor was just one that came up As kind of like why is this use its own thing? It's a personal service. Just like others or Or just general commercial So taking that out as its own use So I think some of them are kind of more in line with how we do the cleanup Smaller scale and then others will probably warrant more discussion So we will be doing that again here on July 14th in this room at 530 401 North Morton Street City Hall and Discussing those and starting the conversation on those and then that will go on as long as you all need it to and then You will make a decision about forwarding those to council with a recommendation and then that will go through council late summer in the fall So we just wanted people got those mailers there It's very legal ease which we have been advised to send send them that way. It makes it kind of complicated So there will be some more I think outreach in that during this week to neighborhood associations and other groups kind of describing What's going on and you can go on our website? Bloomington dot ion dot gov slash planning slash ud o Slash update and then slash 20 25 and you can see the proposed changes listed here And also with a link to how they appear in the red line so so just for a general public's knowledge some of these things might change before the July packet comes out tweaks or Things that we might want to add or take out but these are the general topics that will be discussed And I'm happy to answer any questions on that We just wanted to give a little report because we we've been getting some calls and just so people can know what's going on there Thank you. So these are the final step in our public hearings for our annual maintenance UDO updates so the council passed two of them zeo 06 - 25 and zeo 09 - 25 without amendment zeo 7 - zeo 07 - 25 which was ordinance number 20 25 - 12 had four amendments so three were Scrivener's amendments a missing footnote and two Spelling corrections and one was that the way that I notated to them the change that you all made they didn't They wanted it to be different So they voted on it to clarify with their body that they agreed with what you had said Which was basically that we were not giving the responsibility Related to design of tree grates to the urban forester and as we discussed here We'll keep having that conversation with parks over the next year and engineering but leaving it as is which Has that responsibility with the engineering department? So those were the four amendments that came back For that ordinance, so you will be voting to accept or not those amendments Any questions from commissioners Process so the way this works then is we review what the Common Council has brought back to us and then that and then provided that we Accept it then it would that would fly or did they have to then approve our Accepted amendments again, they it will not go back to them. Okay, so we're the final we will So I will send them a recertification saying that you voted to accept those Okay, yeah, but it will not be heard at a public hearing again and so then the ordinance will the clerk will have the ordinance then go on to the President of Common Council and to the mayor to sign as normal and then we'll make the changes once that's done Okay, if we were to deny These a good question. I think that there's like a clock and they just run you out So the 90 days anyway, okay. All right. Okay, but I'm not positive but I'm pretty sure that's okay. All right.
