Petition for a zoning map amendment to rezone two partials, 2.2, 2.03 acres from commercial two to residential two, medium density residential at 5010 North Lakeview Drive. Petitioner is Guy Kevin Ferris, case number PC 26-50. tonight petitioner Kevin Ferris is requesting to rezone two parcels totaling approximately 2.03 acres from commercial to residential to medium density residential. Subject parcels are located at 5010 North Lakeview Drive. Current uses of the parcels are single family residential and the outdoor storage of our campers, boats, The Monroe County GIS shows parcels have the same address and parcel number, but research from petitioners, engineer, found each showing two separate parcels have never been consolidated into one parcel. The Oldsville Comprehensive Plan designates land to be single-family residential. The Unified Development Ordinance states the intent of residential two zoning is to establish areas for single-family and two-family dwellings. petitioners intent is to construct single family housing on the lots. The parcels have significant great changes and sewer main runs through the middle of the parcels. In our two zoning designation would allow development pattern better suited to the physical characteristics of the property. Our two zoning will allow work around the site constraints because of the setback lot width and lot size requirements. Has a side note, R2 zoning allows same square footage of living area, has residential one zoning. And further, it allows for a smaller neighborhood with a smaller footprint. The reduced development footprint and flexibility associated with R2 zoning will result in more compatible and responsible site design given the property's difficult topography. So the analysis of the required findings one comprehensive plan, the comprehensive plan designates land to be single family residential and both single family and plan neighborhoods. Two current conditions, the change zoning is based on the current conditions of the property and the surrounding character of the land. The parcels are currently zoned commercial too and have been underutilized for a long time. The parcels are narrow, rectangular lots, and commercial two-zoning only allows multifamily dwellings. The surrounding character land is a mixture of land uses that includes single-family residential. The use of the property, the change in zoning, does result in the allowance of the most desirable use of the property. The designation of residential two-zoning aligns with the proposed use of the land, as the use will be single-family residential. Conservation of property values, the use or value of adjacent properties and those throughout the town will not be affected in a substantially adverse manner. The reason of this property to residential two will have an effect on neighboring properties in an adverse manner, will have no effect on neighboring properties in an adverse manner along North Lakeview Drive. Five, responsible development. The change in zoning does promote the responsible development and growth of the property. The proposed use of the property is single family residential. The zoning map amendment will align with the intent of the comprehensive plan and similar zoning along North Lakeview Drive. The plan commission action shall be in the form of favorable, unfavorable or no recommendation to town council, which takes final action on zoning map amendment petition. Staff recommendation, Zoning of residential two is covered in the Ellsville comprehensive plan under neighborhood residential. And there are other properties with single family residential, even though the zoning district is C2, north of the parcels residential in Monroe County. The area will accommodate the proposed use of the single family residential Therefore staff recommends a favorable recommendation be forwarded to the town council to amend the zoning of the parcels, outline a paragraph one from commercial two to residential two. Was, did we rezone that commercial from residential? Correct, we rezoned it commercial three and then with the zoning, when we did the zoning map with the UDO, we did away with commercial three and then it became commercial two. But we changed it from residential to commercial. I don't remember what the county had it zoned when we annexed it. Okay, the other question I have is, do we have a square footage for our house? Sure, the minimum for residential one, the minimum lot size is 8,000 and I think R2, I should have looked it up, it may be five or four, but the setbacks reduced to seven feet on this side in 20, 25 in the front and 15 in the rear, I think. I think. Memory serves when it was passed in order to, by the planning commission in order to make those very southern lots there storage units. I think Kevin Ferris wanted one of the lots to be commercial because he was storing things on. That makes sense. So maybe that's why it was just left commercial at that time. Okay, thank you.
