For this evening, there are no resolutions. There's an ordinance on first reading, which has me a little
bit confused. Ordinance 2026-13 to amend the employee handbook to convert unused holiday hours to floating
holiday hours for employees of the police department. Is this not the second time we've heard this?
Well, I amended it, and what you have in front of you is the amended version. But since I circulated
that, there's been a question about call out time and how that's to be treated. So I need some guidance
from the council on that.
So the change from last time was, as you're aware, the police department asked or the marshal asked
for a change to be made that states that employees of the police department who work 40 hours a week
and work a holiday will receive the normal rate of pay. After that, I was asked to add some language
about employees who work 40 hours and work on a holiday will receive holiday pay and one and one half
times the regular rate of pay. Since then, I've had a question about call out time and where that falls
into this, if it does.
So. Just how that's handled, if it takes precedence over 40 hours plus holiday or if it makes a difference.
It doesn't make a difference and it does take precedence, as far as I'm concerned. We've been doing
it for the last 28 years and I didn't know it was a question. OK, so call out pay is just is going to
be one and a half times, right?
That's beyond the 40 hours. That's right. But when you get called out, if you're only out like 37 minutes,
you get two hours. Everything after that is time and a half, which is more than it's two hours in one
minute, two hours in two minutes. But you always get minimum two hours to call out. It's always been
that. It's a straight rate. It's a straight rate. But it's a move point after.
One hour and 37 minutes or something like that. Well, then if you're getting time in half, you're somewhere
right in there. You get two hours and a minute. So it makes point of it. I guess I'm not sure. Not that
it matters. I'm not sure where that fits in this holiday. It doesn't. I don't know why it's even. OK.

about the fire department open position. I'll try to make this as simple as possible. We'll start with
I'd like to do both positions tonight if possible, but I'm going to do them separate because I think
it'll make it a little easier. So the first one, I would like to bring the name Alex Halter to you.
to fill one of our current full-time spots, offer him a contingent offer based on his PERF physical
passing. He's got three years with us and been a good employee, no problems. So it's complete PERF packet,

Open full-time position August 14th. I've already received a resignation letter from one of our firefighters
was hired up in the Marion County area. And so I would like to offer Amelia Mercer this position contingent
on one. We wouldn't send her for per physical or anything until after the 14th of August.
Okay, go ahead. Because the position doesn't open until the morning of the 14th and then the PERF physical.
So basically this allows me to go ahead and get the PERF physicals scheduled because there's a delay
in getting those. Does that make sense? Yes. So for some reason. But you're not asking to hire her before
she completes the PERF physical. Correct. It would be a contingent offer. So two things have to take
place. One,
It has to be the 14th or after, so that would clear out the existing firefighter that is resigning as
the end of his shift on the 13th. That's his last day of employment. OK. Seems a little more complicated

are. You have a three minute time limit. Hi, my name's David Bauer, and I live on the cusp of Ellitsville
by Bender Lumber, and we're having an issue with the SIP, the new bar that has opened.
We're having a problem with noise pollution and light pollution and also trash and loitering. I kind
of would like to know what the standard for occupancy both inside the building as well as on the patio
is. According to SILCRO 93.45, there's loud and unnecessary noise prohibited as well as 93.46.
prohibited noises 50 foot rule. We are a residential area right behind it and when they have their loud
music it's just we hear it all the time and when we ask them politely if they can turn the music down
they just actually turn it up louder so it's just become this kind of issue that we've been having and
I think it started pretty much on the
weekend of July, the end of July, where they had karaoke for five hours, and we had to endure this till 11 p.m.
So according to Bloomington, they have a noise ordinance till 10 p.m. I'd like to see that happen in
Ellsville too, because it is really an issue for us in that neighborhood, so. So. Okay, thank you.

Yeah, my name's Jay Richardson. As you know, my core, I live. This is like a written store.
Ingrid's right, the sound level is just off the charts. When they started building this beer pub, it
was kind of nice. It was kind of a cool thing. But it didn't turn out like they quite said it was going
to be. They suggested that it was just going to be a small,
Tap Room, and it's turned out to be Deer Creek. There's music every weekend, both nights. And we live
50 feet from the place. And the karaoke is just a, hello? I'd just like some clarification as to what's
permitted.
The sound level is, like I said, is really high. I think we might have gotten the lights maybe taken
care of as far as that goes. We'll see. But, you know, parking is a situation, is an issue. You know,
they park over at Bender Lumber, which I found out today that Bender Lumber doesn't really have an issue
with that, unfortunately. But the problem with it is,
opens them up to having music venue that, you know, it's unlimited people. How many do you want to have
there? But that's our concerns. My wife and I's concerns is, my biggest concern is the sound level.
So, I'd like to see that looked at. And the other issue was, I think a couple weekends ago,
I warned Greg, one of the owners, that most likely one of the neighbors will call the police on him.
with that sound level, and they did. And they issued them a $25 ticket, which did absolutely nothing.
They didn't turn it down. They paid the ticket, then find out that they only issue one ticket a day.
Well, what's to keep them from just keep playing it as long as they want? That doesn't seem right. $25.
I'll pay you that right up front.
You know, I don't want to shut them down, obviously, because I don't want the property sitting empty
right in front of my house. But by the same token, I'm thinking, you know, with that sound level, how
in the world would ever sell my house? You know, it devalued it instantly. So I think it's just something
to consider and to look at to see, you know, what should be done or could be done. OK. So. Thank you

Tracy Richardson, Jay Richardson's wife. I also have a concern that we do have a permanent easement
through the SIP, which causes traffic issues in trespassing. People parking and blocking the easement,
even though we do have the adjoining easement to from the Bender area to the private drive. But we had
put notes, signs, no trespassing because we had
A couple weeks ago, people coming onto our property, coming from Bender, and driving through the easement,
and it's been a big hassle. And that's a big concern, because when we have a medical emergency, which
both my husband and I have, I've had breast cancer, he's had triple bypass. We don't need this.
And if we have a medical emergency, the first place they're going to go is right through the easement,
that easement there, because that was our primary drive. And also, you know, the privacy of our property,
the lights, he thinks they're correct at which they have been shutting them off at night, which is nice,
but they still reflect over onto our property. And we can't even enjoy our patio. We can't sit on our
patio and enjoy
our music, our time, and not have to see everything lit up in our backyard or our front yard as well.
And then to top, the trash is not being contained in their trash cans, so when the guys come to pick
the trash up, it's flying all in front of the property in the easement. So.
I'm Julia Mobley. I'm the newest member of the neighborhood. My husband and I moved in in May of this
year. Beautiful little neighborhood. We thought it was quiet, quaint, back off the road. We were told
it was a pub, which didn't detour us from buying the property because we thought, okay, it's a pub.
How many people can fit in that little building? Well, it's escalated.
Oh, every weekend it's getting bigger and bigger. Bigger bands, more people, more noise. I'm the one
that called the police because that's what I was told to do by my, I can't remember his last name,
I'm sorry, I'm new to the neighborhood. But it's so loud at our house and we're next door to Tracy and
I don't know how they stand it. I can hear it in our living room with our TV on
And that's the opposite end of our home. And it just, the last Saturday night, the noise just kept getting
louder and louder and louder. And then it, I don't know, after they get all drunk or what it is,
I don't know. I'm not against people drinking. I'm not against this being a little pub, but it just
seems like it's growing and there's more people and I'm worried about security for our neighborhood.
You know, we're just right down the road. People get drinking and you don't know what they might or
might not do. We're actually gonna install a security system because of this, because I've never lived
in a neighborhood where I was concerned about my safety. My husband and I are, we've been in the Ellitsville,
our boys went to Ellitsville. We know Ellitsville. We've been in the area and I've never, I just, I'm
baffled that this is even happening in right in the middle of 46 in Ellitsville.
Because it's not a quiet little quaint place of a pub that we were told it was going to be. So I'm concerned
about our security. I'm concerned about the noise and what it's going to do to our property value. Because
if I'd have known this, I would have never had the house. I mean, and I hate to say that. It's a beautiful
area. I don't know if you know where we are back in there.
It's a little gem and Elksfield's a nice community and I hate to see these things happen to the community.

That rounds it out nicely. Council comments. I guess I just, with the public comment, just want to Darla,
what's our noise ordinance, the times again? Well, it's 6 to 11 is the quiet time, but the first speaker
correctly cited the code section that discusses
Prohibition of playing musical instruments, among other things, in such a way as to disturb the peace
and quiet and comfort of the neighboring inhabitants at any time with louder volume than is necessary
for convenient hearing for the person or persons who are in the room, vehicle or chamber in which the
machine or device is operated. And so the procedure is, if it's plainly audible at a distance of 50
feet from the building
vehicle or structure, it's prima facie evidence of a violation. Okay. And to the police, so $25 is the
most we can give? Under the current code section, yes. It's a Class E ordinance violation. Will you
say something? Go ahead. Yeah, please. So I'm aware of the problem, and I was made aware of it last
week. Yes. Yeah. And so I reached out to the owners.
I talked to one owner that I think he's a silent partner, and I guess the other two people that own
it were supposed to get back in town, and he was going to make sure they called me. That hasn't happened.
It's Monday. But I've talked to the police about it. I've talked to planning about it, and I intend
to look at it.
and see how we can mitigate it. I mean, you know, I agree. It was supposed to be a pub. They've done
a really nice job of making the place look nice. But we've got civilians running up against commercial,
and it's a problem. So I hope to be able to come up with a solution that'll make everybody happy. I've
seen the pictures of the lights, and the lights are off the charts too bright. And so I've just
We haven't resolved it. I haven't talked to the owners, but we are working on it, just so you know.
OK. There is also fencing on the outside of the pub. That butts up against one of the properties. OK.
And I mean, it's right there. There isn't any, other than the easement itself, there isn't any space.
So I, too, have looked at it. And so we're hoping that that fencing can extend and maybe hold not only
the noise, but the light in that immediate area. And so it's an ongoing situation. We hope to have it
resolved as soon as possible. OK. What time does the music start and stop?
I live right there too. I think it depends on what they have going on with with with what their program
is who they have scheduled as bands, who the bands are. So it's going to vary. I mean, is it mostly
weekends or are they doing it.
I haven't heard of music, but it's bright, and if it's as loud as it is bright, I can, you know, it's
a problem. I live right by tractor supply, so I'll keep an ear out, too, and see if I can hear it. Can
I add one thing real quick? If you come to the mic. Yeah. Also, has anyone checked with
and see if they've got their outside seating permit with excise. Well, you can bet excise is checkered.
Oh, sorry, Mike. Go ahead. I was just going to suggest the issue wasn't really that bad until they started
having bands there. When they start having bands with drummers and bass players, that's when the sound
levels got to automatically go up. And they're outside? They're outside, yeah.
But if they stick to acoustic guitars, which is what we thought it was going to be, a singer-songwriter
kind of venue, it's not bad. But I mentioned to Greg, one of the owners, that the cops might get called
on tonight. It was a 10-piece band with horns and drums. Really? It was so loud in my house, my walls
were shaking.
and I'm recovering from his surgery and I was about to explode. But anyways, if they kept it
as a singer-songwriter thing, that would be fine, but still keeping the volume in check, but to a certain
degree. And Greg mentioned to me, well, he planned on having something that you and I could sit down
and have a beer and hear each other and not have to yell over the band. So that's not happening.
So I think if they did do that, that would be nice. As far as building the fence higher, you probably
weren't around here at the time, but Mike was. I don't want to see cinema west over there either,
you know? I don't want to see these 20-foot walls of fence. I don't think those were there for the noise.
I agree, they were. I was just talking visually. Well, not even visually.
But. Well, I think the proper thing is for the town, which will be me to talk to the owners and then
I can see you. OK. Maybe I'll try to make it happen before Friday night. And that's fine. I don't you
know, I don't want any argument with them. No, no, I get it. It's it's it's a growing pains of a small
town. But I want them to be successful. But somebody that's already lived here
and lights are quiet nights, I can see where it could be a problem. I saw the light, the lighting itself
