So let's go ahead and move on to new business. And it looks like it's SPP 26.3, which is the Entry East Major Subdivision Primary Plan Amendment. It looks like they're looking for a sidewalk waiver and also a waiver of the final hearing. And I guess... Members, go ahead. So this is for phase three of Gentry East major subdivision. It is a primary plot amendment and a sidewalk waiver request. It's basically for one lot of record. It is 0.46 acres in Perry Township section one at 1017 South Hillside Court. This is a PUD, a planned unit development called Gentry East. The petitioner Is marcy tidwell on behalf of the gentry east homeowners association. So this is a homeowners association that is attempting to Finish a subdivision and they would like some assistance and some relief with not having to build a segment of sidewalk petitioners proposing to amend Phase three to waive that requirement for the sidewalk. It is plotted on lot 105 and currently consists of the one parcel that we've already mentioned in Gentry East. Let's see what else. There's no other deviations being proposed in the Gentry East subdivision. It is just to not build this one segment of sidewalk on lot 105. I think it's 105, correct. They are at the same time across the street from this lots 103 and 104 they are going to be reconstructing existing sidewalk that is there that had some some issues with it so that it would not be able to be adopted into the county inventory with the right of way and so they're making some corrections to the sidewalk across the street The developer of gentry subdivision phase three did not complete the subdivision and the county did not have a financial guarantee large enough to make those required improvements before this developer went bankrupt. And so the HOA has agreed to make final corrections and install missing components of the required infrastructure in order for it to be accepted into the county inventory. And this primary plat is one piece of the puzzle, and it would eliminate those sidewalks on this eastern side of South Hill Court on lot five. So should have probably done this. I will note that there are a lot of different plats that I'll probably flash up on the screen, and there is an interesting Scrivener's error that has occurred through time. Lot 102, lot 105, basically the same. We'll be outlining that area. And I wanted to point that out. There's a couple of paragraphs in the staff report that just explain the history of how this lot changed. So this is the zoning map. The gray indicates a planned unit development. That hashed mark is that this is in area two of the eco overlay. And the comprehensive plan has it as rural transition. Area is on sewer. It is all built out. and has existed as such for maybe 20 years, 20 years. And so this is just trying to finish this up, get it established into the county inventory. And one of those is this yellow area here to not have that sidewalk. And I will also then point out that sidewalk across the street does exist, but it will be rebuilt. The area where you see Beardsley Drive, that is a different phase that is phase six. And so the phase three was amended to kind of allow that continuance of the subdivision. Here we have some staff photos. Well, these are aerial photos. You can see the area here we're talking about where there is a missing sidewalk from a different angle. And then these are some staff photos from out in the field of where the sidewalk could be placed, but it does have some logistics and some burdens that would maybe be problematic that we'll discuss in a moment. And then we do have a letter from the petitioner kind of establishing some of the history of the site and the reasons why they're wanting to ask for this waiver for one of the lots to not have sidewalks in their community. This is the primary plat amendment as proposed and submitted. So the black segment of sidewalk, that is what they would like to remove from the primary plat. And the red segment is the portion that they are going to keep. They're going to reconstruct that and complete that part so that it can be accepted into inventory. We did confirm using our CDO and review the language and we did not have to have an engineered plan set to do this primary platen amendment and so we are this is the drawing that we have come up with you will note that it is not a certified plan by any means this has been drawn on and that is acceptable for this they will not have to do a secondary platen amendment as a result of this primary platen amendment because we do not include sidewalks and also street trees in a secondary plot. So it's just showing usually lots and easements, things like that. This is just a blown up portion of that. You'll note here that in this plot, it shows it as lot 102. We acknowledge it as lot 105. This is the original phases one through five shown here. And so you get a glimpse of what this area looked like before the road came through. before those sidewalk requirements were needed for the reconfiguration of these, I believe it was four lots that went down and drilled down to three lots. And then a road segment went through here. This is phase three's plat, kind of showing that continuation where the lots got reconfigured here. We're labeling it as lot 105 now again. And then this is phase five And phase six is where the sidewalks are clearly indicated on lot 102 on this one, even though we know it's lot 105. And so this is it blown up here showing lot 102, which should be 105. And that's the sidewalk that we're requesting. Those street trees I do believe are in place already now. And so I think the department comments are really important when looking at this and basing staff's findings of fact. So Ben Ayers with the highway department stated that due to existing manhole located in this area, see sheet eight of the construction plan, the sidewalk is not able to be installed within the right of way and meet ADA specifications. So he has no comments or issues with this petition. Our new highway engineer Tim Lawson. He also reviewed this with Ben Ayers and he was fine with the proposal and the waiver and Erica Pena with stormwater program Did have the drainage board review this they approved those drainage plans for Gentry East phase two through five way back in 1998 and These changes would not impact the drainage But they don't need to be heard at the drainage boards after this So with that, we have a staff recommendation to approve the amendment to the subdivision to remove the sidewalk requirement from lot 105, AKA 102, under a sidewalk waiver request based on the findings of fact that the proposed primary plat amendment meets county development ordinance subject to the Highway Engineer and Stormwater Program Manager reports. And again, there is a waiver of final hearing with this as well for petition SPP-26-3. All right, thank you. Any comments from the commissioners before we go to the petitioner? Go to the left. I would like to ask, Rita, in my experience with around the community, you went through a great deal of effort to form your homeowners association and that was no small feat given the fact that the developer had kind of walked away from it. And you finally succeeded in that. And I wonder if you would come to the microphone and at the podium and just say how important this is to get the streets into the county inventory so they can be cared for. Absolutely. In order to do that, first of all, you had to state your name and sign in. OK. Rita Klingelhofer. I'm the president and the treasurer for the HOA for Gentry East. my name real quick. We have been working diligently over the last probably four years to get everything in order in the neighborhood because as Tammy mentioned we have six sections within the neighborhood, four of them have been accepted into county inventory and we have these two that are just hanging out here that the HOA is responsible for in terms of the infrastructure. We have a very small budget where our dues are $240 a lot, which is about $50,000 annually. So we just don't have the finances to maintain these roads the way that they need to be maintained. So we started working with Kelly Abel as our construction consultant after presenting to the neighborhood. We did an assessment. We have collected 97% of those funds to date. everybody is on board in the neighborhood to do the work. We've started the work, getting everything ADA compliant so that we can be accepted. and move forward as a community within the county. So if you guys have any questions, I mean, it has been multiple meetings just as the board with the community itself, the homeowners with Kelly and we've met with the commissioners, we've met with Jackie multiple times and Ben just to make sure we're doing everything that we need to do the right way to get this work done. So thank you for clarifying that I think it's very helpful for the commissioners to know you know that it's been a work in progress for four years and that you've achieved a lot and you've worked with county in order to try to meet the standards and this one waiver will help you get there. Yes and the homeowner is definitely excited not to have to have the sidewalk come through their yard they've got mature trees there. They've lived there for years and obviously would prefer not to have to have that come through their yard at this point as well. So thank you.
